30s Woman Faces Prison for Unfounded Rape Allegation, Legal Consequences Enhanced

A woman in her 30s, who accused her father of rape after he declined to provide her with financial assistance, has been sentenced to a prison term.

As reported by the legal sector on the 1st, the Namyangju Branch of the Uijeongbu District Court's Criminal Division 1, presided by Judge Choi Chi-bong, has imposed a 10-month prison sentence on a woman, referred to as A, for defamation, obstruction of business, and insult.

A was prosecuted for making 11 online posts between May and June of the previous year with the title "I am a victim of familial sexual violence. Please look at this," which defamed her biological father, B.

Within these posts, she inaccurately alleged that "I have been continuously sexually assaulted by my biological father since the age of four, and my mother also endured domestic and sexual violence," "The issue was resolved with 30 million won in damages," and "Severe punishment is justified."

During this time, A also revealed B's real name and business details, resulting in reported operational difficulties for B's business.


 


A is further accused of making six posts alleging that B remarried a woman, C, with whom he was purportedly having an affair.

In February 2021, A initiated a damages lawsuit against B concerning sexual assault at the Incheon District Court, but was unable to substantiate any unlawful actions.

During the criminal proceedings, A maintained that her statements were accurate, but the court dismissed her assertions, referencing the lawsuit's outcome. The court noted the absence of specific evidence or circumstances indicating habitual sexual assault by B.

Moreover, the court deemed A's claims as untrue, given that she had received financial backing from B during her time abroad and after her return, and that she filed the rape accusation shortly following an unmet demand for a considerable sum to operate a cafe.


The court remarked, "False information was shared about the victims due to discontent over financial support denial. The reputations of the victims have suffered irrevocable damage."


The court outlined its reasoning for the sentence, indicating that "the high likelihood of reoffending, as evidenced by her continuing similar posts even post-crime, along with the victims' firm call for stringent punishment, were thoroughly evaluated."
